1. Introduction

Diaspora Health Cover (“Platform”, “we”, “our”, “us”) provides a digital platform that enables Nigerians living abroad to arrange, manage, and pay for health insurance coverage for beneficiaries resident in Nigeria.

All health insurance products made available through the Platform are underwritten and administered by NEM Health, a licensed health insurance provider in Nigeria. Diaspora Health Cover does not provide insurance or medical services.

By accessing or using this Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.

2. Eligibility

To use the Platform, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Be authorised to provide personal and beneficiary information
• Use the Platform for lawful purposes only

We reserve the right to refuse or terminate access where eligibility requirements are not met.

3. Our Role as a Platform

Diaspora Health Cover:

• Facilitates plan discovery, enrolment, and premium payments
• Provides account management and customer support
• Acts solely as a technology and service intermediary

Diaspora Health Cover:

• Does not provide medical care
• Does not underwrite insurance risk
• Does not make claims or coverage determinations
  

All insurance decisions are made exclusively by NEM Health in accordance with applicable policy terms.

4. Beneficiary Information

You confirm and warrant that:

• All beneficiary information provided is accurate and complete
• You have lawful authority to submit such information
• You understand that inaccurate or incomplete information may result in delays, denial of coverage, or policy termination

Diaspora Health Cover is not responsible for consequences arising from incorrect information provided by users.

5. Payments and Billing

• Insurance premiums are processed through approved third-party payment providers
• All payments are subject to verification and confirmation
• Pricing, billing cycles, refunds, and cancellations are governed by the applicable insurance policy terms issued by NEM Health

Diaspora Health Cover is not responsible for payment processor errors, delays, or failures beyond its reasonable control.

6. Coverage, Claims, and Benefits

All matters relating to:

• Coverage eligibility
• Benefits and exclusions
• Claims assessment and approval

are determined solely by NEM Health in accordance with the issued policy documentation. Website content does not replace or modify official policy terms.

7. Limitation of Liability

To the fullest extent permitted by law, Diaspora Health Cover shall not be liable for:

• Medical treatment outcomes
• Claims approvals or denials
• Healthcare provider availability or conduct
• Acts or omissions of insurers, hospitals, or third-party service providers

Our liability, if any, shall be limited to the amount paid by you directly to the platform for services rendered.

8. Indemnification

You agree to indemnify and hold harmless Diaspora Health Cover from any claims, losses, liabilities, or expenses arising from:

• Your misuse of the Platform
• False or misleading information provided
• Violation of these Terms or applicable laws

9. Data Protection and Privacy

Use of the Platform is subject to our Privacy Policy, which governs how personal and beneficiary data is collected, used, and protected. By using the Platform, you consent to data processing in accordance with applicable data protection laws.

10. Suspension and Termination

We may suspend or terminate access to the Platform without prior notice where we reasonably believe there has been:

• Fraud or attempted fraud
• Misuse of the Platform
• Breach of these Terms
• Legal or regulatory non-compliance

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, without prejudice to any mandatory consumer protection laws applicable in your country of residence.

12. Acceptance of Terms

By accessing, registering on, or using Diaspora Health Cover, you confirm your acceptance of these Terms of Use. 

We reserve the right to update or modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
